Uno di questi \u00e8 l\u2019amletico dubbio su chi possa fare l\u2019amministratore.<\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">Possono svolgere l\u2019attivit\u00e0 di amministratore di condominio coloro:<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">1)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">che abbiano il godimento dei diritti civili;<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">2)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">che non siano stati condannati per delitti contro la pubblica amministrazione, l\u2019amministrazione della giustizia, la fede pubblica, il patrimonio o per ogni altro delitto non colposo per il quale la legge commini la pena della reclusione non inferiore, nel minimo, a due anni e, nel massimo, a cinque anni;<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">3)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">che non siano stati sottoposti a misure di prevenzione divenute definitive, salvo che non sia intervenuta la riabilitazione;<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">4)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">che non siano interdetti o inabilitati;<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">5)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">il cui nome non risulti annotato nell\u2019elenco dei protesti cambiari;<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">6)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">che abbiano conseguito il diploma di scuola secondaria di secondo grado;<\/span><\/span><\/span><\/p><p class=\"p3\" style=\"margin: 0cm 0cm 3.75pt 27pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; text-indent: -13.5pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">7)<\/span><\/span> <span class=\"s1\"><span style=\"font-size: 18pt;\">che abbiano frequentato un corso di formazione iniziale e svolgano attivit\u00e0 di formazione periodica in materia di amministrazione condominiale.<\/span><\/span><span class=\"apple-converted-space\"><span style=\"font-size: 18pt;\">\u00a0<\/span><\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span class=\"s1\"><span style=\"font-kerning: none;\"><span style=\"font-size: 18pt;\">2)\u00a0<\/span><\/span><span class=\"s2\"><b><span style=\"font-size: 18pt;\">Amministratore del proprio condominio<\/span><\/b><\/span><span class=\"s1\"><span style=\"font-size: 18pt;\">\u00a0<\/span><\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">Qualora l\u2019amministratore venga nominato tra gli stessi cond\u00f2mini dello stabile (ipotesi molto pi\u00f9 frequente di quanto si possa pensare) i requisiti di cui alle lettere f) e g) non saranno necessari. Quindi, non occorrer\u00e0 n\u00e9 il diploma di scuola secondaria di secondo grado, n\u00e9 aver frequentato un corso di formazione iniziale, n\u00e9 svolgere attivit\u00e0 di formazione periodica in materia di amministrazione condominiale.<\/span><\/span><span class=\"apple-converted-space\"><span style=\"font-size: 18pt;\">\u00a0<\/span><\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span class=\"s1\"><span style=\"font-kerning: none;\"><span style=\"font-size: 18pt;\">3)\u00a0<\/span><\/span><span class=\"s2\"><b><span style=\"font-size: 18pt;\">Norma transitoria per gli amministratori<\/span><\/b><\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">A quanti hanno svolto attivit\u00e0 di amministrazione di condominio (che non \u00e8, necessariamente, atti- vit\u00e0 di amministratore di condominio) per almeno un anno nell\u2019arco dei tre anni precedenti alla da- ta di entrata in vigore della riforma della disciplina condominiale, \u00e8 consentito lo svolgimento dell\u2019attivit\u00e0 di amministratore anche in mancanza dei requisiti di cui alle lettere f) e g). Resta salvo l\u2019obbligo di formazione periodica. Per tali soggetti non sono richiesti, dunque, n\u00e9 il diploma di scuola secondaria di secondo grado, n\u00e9 l\u2019aver frequentato un corso di formazione iniziale.<\/span><\/span><span class=\"apple-converted-space\"><span style=\"font-size: 18pt;\">\u00a0<\/span><\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span class=\"s1\"><span style=\"font-kerning: none;\"><span style=\"font-size: 18pt;\">4)\u00a0<\/span><\/span><span class=\"s2\"><b><span style=\"font-size: 18pt;\">Incarico a societ\u00e0<\/span><\/b><\/span><span class=\"s1\"><span style=\"font-size: 18pt;\">\u00a0<\/span><\/span><\/span><\/p><p class=\"p1\" style=\"margin: 0cm 0cm 3.75pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-kerning: none;\"><span class=\"s1\"><span style=\"font-size: 18pt;\">Possono svolgere l\u2019incarico di amministratore di condominio anche \u2013 secondo la nuova legge \u2013 le \u201csociet\u00e0 semplici, le societ\u00e0 in nome collettivo, le societ\u00e0 in accomandita semplice, le societ\u00e0 per azioni, le societ\u00e0 in accomandita per azioni e le societ\u00e0 a responsabilit\u00e0 limitata.
