margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; Lgs 192\/2005 (richiamati anche dall\u2019appendice A del DM 26\/06\/2015), vi sono alcuni casi in cui non e\u0300 previsto che l\u2019immobile venga dotato del certificato energetico.<\/span><b><\/b><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt;\">Nello specifico, l\u2019obbligatorieta\u0300 di redigere l\u2019APE decade nei seguenti casi:<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Edifici industriali e artigianali in cui gli ambienti sono riscaldati per esigenze del processo produttivo o utilizzando reflui energetici del processo produttivo non altrimenti utilizzabili;<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Edifici agricoli e rurali non residenziali sprovvisti di impianti di climatizzazione;<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Fabbricati isolati con una superficie utile totale inferiore a 50 mq;<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Edifici non compresi nelle categorie di edifici classificati sulla base della destinazione d\u2019uso (di cui all\u2019articolo 3 del d.P.R. 26 agosto 1993, n. 412) il cui utilizzo non prevede l\u2019installazione e l\u2019impiego di sistemi tecnici di climatizzazione (box, cantine, autorimesse, parcheggi multi-piano, depositi, strutture a protezione degli impianti sportivi);<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Edifici adibiti a luoghi di culto e allo svolgimento di attivita\u0300 religiose;<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Ruderi, purche\u0301 tale stato venga espressamente dichiarato nell\u2019atto notarile;<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 36pt; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; text-indent: -18pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt; font-family: Symbol;\">\u00b7<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 18pt;\">Fabbricati in costruzione \u201cal rustico\u201d o nello stato di \u201cscheletro strutturale\u201d, purche\u0301 tale stato venga espressamente dichiarato nell\u2019atto notarile.<br \/><br \/><\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><b><span style=\"font-size: 18pt;\">E se non allego il l\u2019APE al Contratto cosa succede?<br \/><\/span><\/b><span style=\"font-size: 18pt;\">Se al contratto non viene allegato l\u2019APE non si rischia l\u2019annullamento del medesimo (il contratto sara\u0300 infatti valido a tutti gli effetti) bensi\u0300 una sanzione amministrativa che oscilla tra i 3.000 e i 18.000 euro, a carico delle parti contraenti.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><b><span style=\"font-size: 18pt;\">APE e compravendite di immobili (rogito)<br \/><\/span><\/b><span style=\"font-size: 18pt;\">In occasione di trasferimento di un immobile il proprietario deve provvedere a far redigere l\u2019Attestato di prestazione energetica e mostrarlo al futuro acquirente. Al momento del passaggio di proprieta\u0300, il certificato energetico verra\u0300 consegnato al nuovo proprietario.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt;\">Nell\u2019atto di vendita verra\u0300 apposta una specifica clausola con la quale l\u2019acquirente dichiara di aver ricevuto le informazioni e la documentazione, comprensiva dell\u2019attestato, in ordine alla prestazione energetica dell\u2019immobile.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt;\">In caso di mancata allegazione del certificato energetico al contratto sono previste sanzioni che variano tra i \u20ac 3000 ed i \u20ac 18000, mentre e\u0300 stata eliminata la nullita\u0300 dell\u2019atto notarile.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><b><span style=\"font-size: 18pt;\">APE e locazione (affitti)<br \/><\/span><\/b><span style=\"font-size: 18pt;\">Come avviene in caso di compravendita immobiliare, anche nei contratti di locazione soggetti a registrazione dovra\u0300 essere apposta una clausola specifica con la quale il conduttore dichiara di aver ricevuto l\u2019attestato di prestazione energetica. In caso di affitto di singole unita\u0300 immobiliari l\u2019APE puo\u0300 non essere allegato al contratto di locazione ma cio\u0300 non esclude che debba comunque essere redatto obbligatoriamente.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt;\">Come per la compravendita, anche in caso di affitto il proprietario dovra\u0300 mostrare all\u2019affittuario l\u2019attestato di prestazione energetica durante le fasi di contrattazione e consegnarlo al momento della registrazione del contratto.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt;\">Anche per i contratti di affitto sono previste sanzioni particolarmente onerose se l\u2019APE non viene presentato al momento della registrazione del contratto di affitto. Si incorre in una sanzione che va da 1.000 a 4.000 euro (se la durata della locazione non eccede i tre anni la sanzione viene ridotta alla meta\u0300).<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 18pt;\">I controlli e le sanzioni vengono effettuati dalla Guardia di Finanza o direttamente dall\u2019Agenzia delle Entrate al momento della registrazione del contratto. Al momento della registrazione del contratto allo sportello dell\u2019Agenzia delle Entrate gli impiegati richiedono infatti di visionare anche l\u2019 Attestato di Prestazione Energetica.<\/span><\/p><p style=\"margin-right: 0cm; margin-left: 0cm; font-size: 12pt; font-family: 'Times New Roman', serif; color: #000000; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><b><span style=\"font-size: 18pt;\">l\u2019ACE e\u0300 ancora valida o devo fare il nuovo APE?<br \/><\/span><\/b><span style=\"font-size: 18pt;\">Se gli ACE sono stati redatti precedentemente al 4 agosto 2013, essi non perdono valore e rimangono validi per dieci anni a partire dalla data del rilascio. Secondo quanto previsto dall\u2019 Art.6 comma 10 del D.Lgs. 192\/05, \u201cl\u2019obbligo di dotare l\u2019edificio di un attestato di prestazione energetica viene meno ove sia gia\u0300 disponibile un attestato in corso di validita\u0300, rilasciato conformemente alla direttiva 2002\/91\/CE\u201d.
